Fiscal Obligations for U.S. Expats living in Portugal.
As U.S. Citizen Expat living in Portugal, you have different fiscal obligations in both countries, depending on the fiscal status that you have in Portugal and another two obligations in the U.S.
As Portuguese resident you must file the income tax return, IRS Modelo 3. Income Tax Filing: “Imposto sobre o Rendimento das Pessoas Singulares (IRS)” under the different categories A to H income; some status will exempt you to pay taxes in Portugal but you will have to file worldwide income in Portugal as the Non-habitual Resident.
As U.S. Citizen you must file, the U.S. individual tax return, Form 1040, reporting your worldwide income and the FBAR (Foreign Bank Account Report), reporting all your financial accounts outside the U.S.

1. Immediate Concerns for Portuguese Residents with U.S. Tax Obligations
• U.S. citizens/permanent residents must file Form 1040 annually, reporting worldwide income, regardless of where they live.
• The option of the NHR in Portugal is no longer in place and the new NHR 2 is not available for everybody. Now new expats will have to pay all taxes in Portugal where it is also required to declare worldwide income.
• Those living in Portugal may benefit from the Treaty to avoid the double taxation as well as Foreign Earned Income Exclusion (FEIE) under the Physical Presence or Bona Fide Residence tests, or from the Foreign Tax Credit (Form 1116) to avoid double taxation.
• Must file FinCEN Form 114 (FBAR) if the aggregate value of non-U.S. financial accounts exceeded $10,000 during the calendar year and potential filing of Form 8938 (FATCA) if foreign financial assets surpass IRS thresholds.
